These Terms of Service ("Terms") are an agreement between you and McQ Technologies, Inc., a Delaware corporation ("Stormin," "we," "us," or "our"), which operates Stormin Sports Cards at stormin.ai and app.stormin.ai (the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Scope. These Terms govern the Stormin collector app and your account. Purchases of sealed packs through our online shop are governed by separate shop terms.
Please read Section 6, which explains that card values shown in the Service are estimates, and Sections 11 and 12, which limit our liability to you.
1. Beta Service
The Service is currently in beta. This means:
- features may change, break, or be removed without notice;
- the card scanner and card database contain errors, and scanned results may be wrong;
- card values and comparable sales may be incomplete, out of date, or inaccurate;
- the Service may be unavailable at times; and
- we may reset, modify, or lose data during development.
The Service is provided on an "as is" and "as available" basis. Do not use Stormin as your only record of your collection.
2. Eligibility and Accounts
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms.
You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity that occurs under your account. Notify us at Ethan@stormin.ai if you believe your account has been accessed without your authorization.
You may create your account with an email address and password or by signing in with Google. If you use Google sign-in, your use of Google's services is governed by Google's own terms and privacy policy.
You may delete your account at any time by emailing Ethan@stormin.ai from the address on your account.
3. Fees
The Service is free during the beta period. No payment is required and no billing is enabled.
We expect to offer paid subscription features in the future. We will not charge you for anything without first giving you notice and obtaining your agreement to the applicable price and terms.
4. Your Content
"Your Content" means the card photos, collection data, notes, profile information, and anything else you upload or enter into the Service.
You keep ownership of Your Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting and display), and display Your Content solely for the purpose of operating, improving, and supporting the Service. This license ends when you delete Your Content or your account, except for backup copies retained for a limited period as described in our Privacy Policy.
You represent that you have the rights necessary to submit Your Content and that it does not infringe anyone else's rights or violate any law.
5. Public Profiles
Your profile and the cards in your collection are visible to other users of the Service. The estimated values of your cards, your collection total, any purchase prices you enter, and your gains and losses remain private to you. See our Privacy Policy for details.
6. Card Values Are Estimates, Not Advice
This section is important. Read it carefully.
Card values, price histories, comparable sales, predicted values for grades without sales, and collection totals displayed in the Service are estimates for informational purposes only. They are generated from third-party sales data and our own methodology, and they are not:
- an appraisal, certification, or guarantee of value;
- an offer to buy or sell any card;
- financial, investment, or tax advice; or
- a representation that any card can be bought or sold at the price shown.
Estimated values may be inaccurate, incomplete, stale, or simply wrong. Card markets move quickly, sales data is imperfect, grades affect value substantially, and the scanner may misidentify a card. Where a grade has no recorded sales, any value shown is a prediction and should be treated as such.
You are solely responsible for your own buying, selling, grading, insuring, and trading decisions. Verify prices independently before you transact. We are not a party to any transaction between you and anyone else, and we are not responsible for the outcome of any transaction you enter into after consulting the Service.
7. Third-Party Data
The Service displays data licensed from third-party providers, including sales data and card images. That data is owned by its providers and is made available to you for your personal, non-commercial use within the Service. You may not scrape, bulk download, resell, redistribute, or build a competing dataset or product from data obtained through the Service.
8. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- scrape, crawl, or use automated means to access or extract data from the Service;
- circumvent usage limits, rate limits, authentication, or other technical restrictions;
- reverse engineer, decompile, or attempt to derive the source code of the Service;
- upload content that is unlawful, infringing, fraudulent, obscene, harassing, or malicious;
- upload viruses, malware, or other harmful code;
- impersonate another person or misrepresent your affiliation with anyone;
- interfere with the operation, security, or integrity of the Service; or
- use the Service to build or assist a competing product.
We may suspend or terminate accounts that violate this section.
9. Our Intellectual Property
The Service, including its software, design, branding, card database structure, valuation methodology, and all related intellectual property, is owned by McQ Technologies, Inc. and its licensors. These Terms do not grant you any rights in it other than the limited right to use the Service in accordance with these Terms.
The names, logos, and trademarks of card manufacturers, sports leagues, teams, players, grading companies, and trading card games referenced in the Service belong to their respective owners. Stormin is not affiliated with, endorsed by, or sponsored by any of them.
10. Termination
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, if your use creates risk or legal exposure for us, or if we discontinue the Service. If we terminate your account without cause, we will make a reasonable effort to give you an opportunity to export or retrieve Your Content.
Sections 4, 6, 7, 9, 11, 12, 13, and 14 survive termination.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that card identifications or values will be accurate, or that any data will be preserved without loss.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, McQ Technologies, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, loss of collection value, or losses arising from any purchase, sale, trade, grading decision, or insurance decision you make, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Because the Service is free during beta, this amount will typically be $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless McQ Technologies, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, your violation of these Terms, or your violation of any law or the rights of any third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction there.
15. Changes to These Terms
We may update these Terms as the Service develops. When we do, we will revise the "Last updated" date above. If we make material changes, we will notify account holders by email or through the Service before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms.
16. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
